 OMA Financial Services Ltd T/A Q Financial Advisors are financial brokers who provide bespoke financial advice to individuals, employees, and business owners. We specialize in helping our clients to find the right financial products to best suit their needs. We provide advice on pensions, savings, investments, life insurance, serious illness, income protection, and general financial planning.

3. What personal information do we collect about you?

We collect and process different types of personal information. Dependant on your choice of product or service, the type of personal information and method of collection will vary. We need to be able to contact you, confirm your identity and gather your personal information to ensure we deliver the best possible customer experience when providing products and services. 

You may choose to give us your personal information through various mediums by accessing our website, by filling in forms and corresponding with us by phone, email or otherwise. 

The personal information we may collect about you includes but is not limited to the following: 

  • Consultations and marketing e.g., contact information.
  • identity and contact information e.g., name, signature, date of birth, proof of ID, proof of address, PPS number, nationality, gender, address, email address, phone numbers and residency.
  • financial information e.g., bank account details, income details, employment status, assets and liabilities. This information is necessary for our Fact Find with our clients.
  • Assessing insurance risks – underwriting e.g., medical assessment/evidence

You may decide you do not want to share your personal information with us but doing so may limit the products and services we are able to provide you with. However, when we request personal information, we will tell you if providing it is a contractual requirement or not, whether we need it to comply with our legal and regulatory obligations and the consequences of failing to provide such personal information. 

4. Why we are processing your data? Our legal basis.

In order for us to provide you with our financial services, it is necessary for us to collect and process your personal data. We are required, therefore, to inform you of the legal basis for processing your personal data. One such legal basis is that the processing is necessary for the performance of the advisory services contract (and any other contract) that we commit to delivering to you from time to time. Another legal basis is that some processing is necessary for the purposes of the legitimate interest that we have, as a firm that is authorized and regulated by the Central Bank of Ireland, in the proper administration and correct operation of our firm. There may also be circumstances where the legal basis for processing your personal data is consent (where we have sought it and it has been provided to us), in which case that consent may be withdrawn at any time.

5. How OMA Financial Services Ltd will use the personal data it collects about me?

We will process (collect, store & use) the information you provide in a manner compatible with the EU’s General Data Protection Regulation (GDPR). We will endeavour to keep your information accurate and up to date, and not keep it longer than is necessary.

6. Special categories of personal data

If we collect any special categories of personal data (e.g., health, religious beliefs, racial, ethnic origin – financial information is not classified as special categories of personal data) – we will obtain your explicit consent.

7. Who are we sharing your data with?

We may pass your personal data on to third party service providers contracted to OMA Financial Services Ltd in the course of dealing with you. Any third parties that we may share your data with are obliged to keep your details securely, and to use them only to fulfill the service they provide on your behalf. When they no longer need your data to fulfil this service, they will dispose of the details in line with our procedures. 

If we wish to pass your sensitive personal data onto a third party, we will only do so once we have obtained your explicit consent unless we are legally required to do otherwise. 

If we need to transfer personal data to a third party or outside the EU we as the data controller will ensure the recipient (processor or another controller) has provided the appropriate safeguards and on condition that enforceable data subject rights and effective legal remedies for you the data subject are available.

We facilitate you, our clients, rights in line with our data protection policy and the subject access request procedure. This is available on request. 

You have the right to:

  • Right of rectification – request that we correct or update your personal information.
  • Right to restriction of processing – restrict our use of your personal information.
  • Right to object – object to our use of your personal information.
  • Right of portability – have the data we hold about you transferred to another organisation.
  • Right to be forgotten – request we delete your personal information.

All the above requests will be forwarded should a third party be involved as we have indicated in the processing of your personal data. 

Your right to obtain personal information cannot adversely affect the rights and freedoms of others, therefore, we cannot provide personal information about other people without their consent. 

9. Who can I make a complaint to?

Our Compliance Department is responsible for the investigation of complaints. 

You also have the right to make a complaint to the Data Protection Commission.
